Teamsters Local 97 v. UMDNJ
UMDNJ and Teamsters Local 97, PERC Docket No. AR-2011-603 (Job Rate System)
On July 20, 2011, Arbitrator Joel Weisblatt issued a decision sustaining a grievance filed by Teamsters Local 97 against the University of Medicine and Dentistry of New Jersey. Local 97 was represented by James M. Mets, Esq. The grievance alleged that UMDNJ violated the collective negotiations agreement by refusing to pay unit members contractually guaranteed wage increases. Specifically, UMDNJ failed to pay progression to new hires from the probationary rate to a job rate to a two year rate. The contract required successful completion of a 180 day probationary period for the first movement and then completion of two years of qualified service for the last movement. The Arbitrator agreed with the evidence presented by the union which he found to be clear and convincing that the employer violated the provisions of the contract when it froze movement on the job rate system, mid-contract term, effective July 1, 2008. Accordingly, he ordered that the grievance be sustained and that the UMDNJ make whole all affected bargaining unit employees through the payment of back pay equaling that which would have applied had the employer continued to adhere to the express provisions of the job rate system.
