North Brunswick PBA and SOA v. Township of North Brunswick
In the matter of the arbitration between the Township of North Brunswick and North Brunswick PBA and SOA, PERC Docket No. AR-2010-085
By an Award dated July 11, 2011, Arbitrator Gerard Restaino sustained a grievance filed by PBA Local 160 and the North Brunswick SOA regarding the Town’s denial of reimbursement of the tuition for the college level Certified Public Manager’s Program. In that case, James M. Mets, Esq. argued on behalf of the union that the program meets the requirements of the collective negotiations agreements between the PBA and SOA and the Township and therefore must be paid for by the Town. The contracts between the parties required tuition reimbursement for officers who attend school for the purposes of obtaining police education. The Township argued that the course was not one involving police education. The Town claimed that the CPM is simply a training course and should not be covered by the contract. The Arbitrator agreed that based on the evidence presented by the PBA and SOA, the CPM does meet the requirement that it be for police education. Accordingly, he sustained the grievance and ordered the Town to reimburse any officer who was not paid for the CPM Program.
