October 29, 2010 – Township of Springfield v. PBA Local No. 76
In the Town of Springfield and PBA Local 76, PERC held that the PBA established irreparable harm and a substantial likelihood of succeeding on its unfair practice charge regarding a unilateral reduction in health benefits. While the change was allowed to proceed, PERC ordered significant safe guards so that PBA bargaining unit members would not suffer any loss of benefits. The safe guards included the establishment of a fund to be used by PBA bargaining unit members for up-front payments to medical care providers and reimbursement for out-of-pocket expenses.

September 2, 2010 – Judge reverses suspension of Summit police officer
SUMMIT — The suspension of Police Officer John Rice, a 24-year veteran of the Summit Police Department, has been reversed by a Superior Court judge.
Share The 29-day suspension was imposed last year by Summit Police Chief Robert Lucid for infractions relating to violations of the department’s internal affairs policy.

Woodbridge, NJ – Friday, April 23, 2010
Today the Professional Firefighters Association of New Jersey (PFANJ) and Teamsters Local 97, filed suit in Superior Court of Mercer County against Governor Christie, Senate President Sweeney, Assembly Speaker Oliver, State Treasurer Sidamon-Eristoff, and the NJ Senate and NJ General Assembly.
The suit contends that recent law (P.L. 2010 Chapter 2) imposing a 1.5% pay reduction to cover healthcare costs violates public employees’ Federal and State Constitutional rights.
"In passing this law, the Members of the State Legislature, from both political parties, rushed to appease the Governor’s desire to circumvent collective negotiations. The result is a statute that violates long-standing principles of fair play as well as the State and Federal Constitutional rights of our clients' members. We anxiously await our day in court to present our clients’ claims to an impartial judiciary," stated James M. Mets, attorney for the Plaintiffs.
Once counsel for the plaintiffs receive the "filed" copy back from the court, the suit will be served on the defendants as soon as next week.

Seminars
On April 23, 2010, Kevin P. McGovern appeared as a guest speaker at the 30th Annual PERC Conference. Mr. McGovern was part of a panel discussion entitled “Negotiating in Difficult Economic Times” which focused on the legal and practical questions facing labor and management in the current fiscal climate. This issue has become all the more important in light of the State government’s recent assault on the collective bargaining process, a topic that will surely be discussed.
On March 23, 2010, James M. Mets, Esq. presented a seminar on Grievance Processing, which was sponsored by the American Arbitration Association.
