May 21, 2010 – Superior Court Decision in the FMBA and State PBA’s Order to Show Cause – The recently passed legislation requiring employee contribution to health care.

Woodbridge, NJ – Friday, April 23, 2010 – Today the Professional Firefighters Association of New Jersey (PFANJ) and Teamsters Local 97, filed suit in Superior Court of Mercer County against Governor Christie, Senate President Sweeney, Assembly Speaker Oliver, State Treasurer Sidamon-Eristoff, and the NJ Senate and NJ General Assembly.

The suit contends that recent law (P.L. 2010 Chapter 2) imposing a 1.5% pay reduction to cover healthcare costs violates public employees’ Federal and State Constitutional rights.

"In passing this law, the Members of the State Legislature, from both political parties, rushed to appease the Governor’s desire to circumvent collective negotiations. The result is a statute that violates long-standing principles of fair play as well as the State and Federal Constitutional rights of our clients' members. We anxiously await our day in court to present our clients’ claims to an impartial judiciary," stated James M. Mets, attorney for the Plaintiffs.

Once counsel for the plaintiffs receive the "filed" copy back from the court, the suit will be served on the defendants as soon as next week.
